Terms of Service

1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Customer," or "Subscriber") and Zivaan Solutions (operating as SocialAPI), a company registered in India.

By creating an account, accessing, or using the SocialAPI platform โ€” including our website, dashboard, REST APIs, webhooks, and any related services (collectively, the "Service") โ€” you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

๐Ÿšซ No Refunds Policy: We are not providing any kind of refund for any subscription or service. All payments made to SocialAPI are strictly non-refundable under any circumstances.

2 WhatsApp Usage & Risk Disclosure

๐Ÿ’ณ Direct Message Charges: Meta (WhatsApp) conversation charges are extra as per their pricing and are payable directly by the customer from their WhatsApp account/payment method linked to Meta. SocialAPI subscription fees ONLY cover platform access.
๐Ÿšซ Risk of Account Block: Any misuse of the platform, violation of WhatsApp Business Policies, or sending unsolicited/spam messages may lead to your WhatsApp account being blocked or suspended by Meta. SocialAPI is not responsible for platform-level restrictions imposed by Meta.

Proper Usage Instructions:

  • Only send messages to contacts who have explicitly opted in to receive communications.
  • Avoid sending spam or bulk marketing messages without clear consent.
  • Ensure compliance with Meta's WhatsApp Business Messaging Policy.
  • Respond to user queries promptly to maintain account health.

3 Description of Service

SocialAPI is a SaaS platform providing programmatic access to the WhatsApp Business Cloud API (provided by Meta Platforms, Inc.), enabling:

  • Sending and receiving WhatsApp messages at scale.
  • Broadcasting bulk messages to opted-in contact lists.
  • Managing official WhatsApp Message Templates.
  • Real-time webhooks and RESTful API for integrations.

4 Eligibility & Registration

To use the Service, you must be at least 18 years of age and have the legal capacity to enter into binding contracts. You must maintain a valid WhatsApp Business Account approved by Meta.

5 Subscription & Billing

Fees are billed in advance on a monthly or annual basis. All fees are inclusive of applicable taxes (GST). Subscriptions automatically renew unless cancelled at least 48 hours before the renewal date.

โš ๏ธ Non-Payment: Failure to pay fees when due may result in suspension of your account and loss of access to the Service.

6 Acceptable Use Policy

The following activities are expressly prohibited:

  • Sending unsolicited, spam, or bulk messages without consent.
  • Distributing malware, viruses, phishing content, or scams.
  • Sending messages involving prohibited content (illegal substances, firearms, adult content, etc.).
  • Impersonating any entity or misrepresenting your affiliation.

7 Disclaimers & Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. SOCIALAPI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS OR DATA.

SOCIALAPI IS NOT LIABLE FOR ANY ACTIONS, RESTRICTS, OR POLICY VIOLATIONS IMPOSED DIRECTLY BY META ON YOUR WHATSAPP BUSINESS ACCOUNT.

8 Termination

We may suspend or terminate your account immediately if you breach these Terms, if your account is involved in fraudulent activity, or if your WhatsApp Business Account is banned by Meta.

9 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.
